Privacy Policy

1. Who We Are
Beak School LLC ("Beak School", "we", "us", or "the Company") operates the website beakschool.com and the products and services offered through it, including the member area, courses and course videos, the member community known as The Flock, live group calls and Q&A sessions, one-on-one coaching bookings, and our email communications (together, the "Site").
This Privacy Policy explains what information we collect, why we collect it, who we share it with, how long we keep it, and the choices and rights you have. It applies to visitors, free subscribers, paying members, and coaching clients. Please also read our Terms of Use, which govern your use of the Site.
Contact for privacy questions and requests: BeakSchool@beautyofbirds.com, or Beak School LLC, 1364 South 1270 East, Spanish Fork, Utah.
2. Information We Collect
Information you give us directly:
- Account information: your name or display name, email address, password (stored only as a salted hash), profile photo, and account preferences.
- Bird profiles: the names, species, ages, photos, and behavior notes you choose to add about your birds.
- Community content: posts, comments, reactions, photos, videos, and direct messages you submit inside The Flock.
- Quiz and assessment answers: the responses you give in our quizzes and readiness assessments, and the email address you use to receive your result.
- Purchase and billing records: what you bought, when, the amount, currency, subscription status, refund and dispute history, and the last four digits and card brand as reported back to us by our payment processor. We do not receive or store full card numbers.
- Booking details: the dates, times, time zone, and the goals or questions you submit when you book a coaching call or Q&A ticket.
- Support and correspondence: the messages, attachments, and contact details you send us by email or through in-app support.
Information we collect automatically:
- Device and log data: IP address, browser type and version, operating system, referring and exit pages, pages viewed, and timestamps, recorded by the standard operation of our servers.
- Usage data: which courses, lessons, and videos you open, your lesson progress and completion, and feature usage inside the member area.
- Email engagement: whether an email we sent was delivered, opened, clicked, bounced, or unsubscribed.
- Cookies and similar technologies, as described in Section 9.
Information from third parties: our payment processors tell us the outcome of your payment, subscription, refund, or dispute; our email provider tells us delivery and engagement results; and if you sign in with a third-party login such as Google, that provider tells us your name, email address, and profile image.
We do not intentionally collect special category data such as health, biometric, racial, religious, or precise geolocation information, and we ask that you not submit it.
3. How We Use Your Information
- To create and secure your account, authenticate you, and give you access to the courses, community, and calls your membership includes.
- To take and process payments, manage subscriptions, issue refunds, apply our refund policy, and respond to billing disputes.
- To deliver, host, and improve our training content, and to keep your lesson progress in sync across devices.
- To run the community, moderate content, and enforce our community rules and Terms of Use.
- To operate live group calls, Q&A sessions, and coaching bookings, including reminders and follow-ups.
- To power AI-assisted features, such as answering training questions using our own training material. Your inputs are sent to an AI provider to generate a response; we do not authorize those providers to train their public models on your inputs.
- To send you service messages you cannot opt out of while you hold an account, such as receipts, renewal notices, password resets, and important changes to these policies.
- To send marketing emails about our products, when you have subscribed or purchased, until you unsubscribe.
- To measure and improve marketing, including understanding which pages and ads lead to sign-ups.
- To detect, investigate, and prevent fraud, abuse, account sharing, chargeback fraud, and security incidents.
- To comply with legal, tax, and accounting obligations, and to establish, exercise, or defend legal claims.
If you are in the EU, UK, or another region with similar law, our legal bases are: performance of our contract with you (account, purchases, access to content, support); your consent (marketing emails where consent is required, non-essential cookies, optional community sharing); our legitimate interests (security, fraud prevention, product improvement, analytics, defending claims); and compliance with a legal obligation (tax records, responding to lawful requests). Where we rely on consent, you may withdraw it at any time.
4. Payments
Card payments are processed by Stripe, and PayPal payments are processed by PayPal. Your full card or bank details are collected and handled directly by those processors under their own privacy policies, not by us. We receive only the information we need to fulfil your order and support your account, such as the amount, currency, status, card brand, last four digits, and the billing name and email you provided.
We retain purchase, refund, and dispute records as required for tax, accounting, and fraud-prevention purposes even after you close your account. When a payment dispute is opened, we may provide the payment network or processor with evidence about your account, including purchase records, access and usage logs, and correspondence with us, in order to respond to that dispute.
5. Live Calls, Q&A Sessions, and Recordings
Our live group calls and Q&A sessions run on a third-party video platform (Daily). When you join, that platform processes your name or display name, and your camera and microphone streams if you choose to enable them. You control camera and microphone access through your browser and can join with both turned off.
Live sessions are commonly recorded. Recordings are focused on the trainer and are added to the member course library so members can watch replays. If you speak, ask a question, or turn your camera on, your voice, likeness, display name, and the content of your question may be captured in that recording and visible to other members. Chat messages sent during a session may also be retained.
Before joining a live session you are asked to accept our live-session terms. If you do not want to appear in a recording, keep your camera and microphone off and submit questions in writing. If you appear in a recording and want it reviewed or removed, email BeakSchool@beautyofbirds.com and we will review the request, though we may be unable to remove content where doing so would degrade a lesson already delivered to other members.
6. Community and User-Generated Content
Content you post to The Flock, including your display name, profile photo, bird profiles, posts, comments, reactions, photos, and videos, is visible to other members of the community by default and, where a page is public, may be visible to anyone with the link. Please do not post information about yourself or others that you would not want others to see.
We and our moderators can view, moderate, hide, or remove community content and can act on reports. Moderation decisions, reports, and enforcement records are retained so we can apply our rules consistently. Direct messages between members are private to those members, but may be reviewed by us when reported or when we investigate abuse, safety concerns, or a violation of our Terms of Use.
Community rules, reporting, and enforcement are described further in our Terms of Use and our community guidelines.
7. Email Communications and Your Choices
Marketing emails include an unsubscribe link in every message, and we honor list-unsubscribe requests sent by your email client. Unsubscribing stops marketing email but does not stop essential account and transactional email such as receipts, renewal notices, and password resets, which we send for as long as you hold an account. If you no longer want any email from us, ask us to close your account.
We keep a suppression record of addresses that have unsubscribed or hard-bounced so we do not email them again. We do not send you email on behalf of unrelated third parties.
8. Service Providers We Share Information With
We do not sell or rent your personal information. We share it only with service providers who process it on our behalf under contract, and only as needed to run the Site:
- Hosting, database, authentication, and file storage: Lovable Cloud, built on Supabase, and our website hosting and content-delivery providers.
- Payments and subscriptions: Stripe and PayPal.
- Transactional and marketing email delivery: Resend.
- Live video calls and recording: Daily.
- AI-assisted features: our AI model providers, including Google Gemini models accessed through our platform's AI gateway.
- Analytics and advertising measurement: Google Analytics and the Meta (Facebook) advertising pixel, where enabled.
We may also disclose information to our professional advisers such as accountants and lawyers, to a successor entity in connection with a merger, acquisition, or sale of assets, and to authorities or other parties where we believe in good faith that disclosure is required by law, needed to enforce our Terms of Use, or necessary to protect the rights, property, or safety of Beak School, our members, or the public.
9. Cookies and Tracking Technologies
Cookies are small files stored by your browser. We use the following categories:
- Strictly necessary: session and authentication cookies and local storage that keep you signed in, protect against cross-site request forgery, and remember your consent choices. The Site cannot function without these.
- Preferences: remembering your display settings, currency, dismissed notices, video position, and drafts you are working on.
- Analytics: understanding which pages are viewed and how the Site performs, so we can improve it.
- Advertising and attribution: measuring which ads and referral links lead to sign-ups and purchases, including affiliate referral tracking.
Most browsers accept cookies by default. You can refuse or delete cookies in your browser settings, but if you block strictly necessary cookies parts of the Site will not work, including signing in. Where required by law we ask for your consent before setting non-essential cookies, and you can change that choice at any time. We also honor the Global Privacy Control signal where your browser sends one. We do not respond to legacy "Do Not Track" browser headers, which have no agreed standard.
10. How Long We Keep Information
- Account and profile data: for as long as your account is open, and then deleted or anonymized within a reasonable period after you ask us to close it.
- Purchase, refund, tax, and dispute records: retained for at least seven years, or longer where tax or accounting law requires it, even after account closure.
- Community content: retained while your account is open. When your account is deleted we remove or de-identify your profile, and we may retain posts in place in an anonymized form where they form part of a public conversation others rely on.
- Live-call recordings: retained in the course library for as long as the lesson remains part of our catalog.
- Email engagement data: retained while you are subscribed, plus a limited period afterwards; suppression records are retained indefinitely so we do not email you again.
- Server and security logs: typically retained for up to 12 months.
11. Security
We take security seriously. Data is transmitted over encrypted connections (HTTPS), passwords are stored only as salted hashes, access to member and billing data is limited to staff who need it, database access is governed by row-level security rules, and card data is handled by our payment processors rather than by us.
No method of transmission or storage over the internet can be guaranteed to be completely secure. While we work to protect your information, we cannot warrant absolute security, and you transmit information to us at your own risk. If a breach affects your personal information, we will notify you and any regulator as required by applicable law. To report a suspected vulnerability, email BeakSchool@beautyofbirds.com.
12. Your Privacy Rights
Wherever you live, you can ask us to access, correct, or delete your personal information, or to stop sending you marketing email.
If you are in the EU or UK (GDPR and UK GDPR), you also have the right to: access your data; have inaccurate data corrected; have your data erased; restrict processing; object to processing based on legitimate interests, including direct marketing; receive a portable copy of data you gave us; withdraw consent at any time; and lodge a complaint with your local data protection authority (in the UK, the Information Commissioner's Office). We do not make decisions about you based solely on automated processing that produce legal or similarly significant effects.
If you are a California resident (CCPA and CPRA), you have the right to: know what personal information we collect, use, and disclose and the categories of recipients; request a copy of that information; request correction; request deletion; opt out of the sale or sharing of personal information and of targeted advertising; limit use of sensitive personal information; and not be discriminated against for exercising these rights. We do not sell personal information for money. Our use of advertising and analytics cookies may be treated as "sharing" for cross-context behavioral advertising under California law; you can opt out through your cookie settings or by sending a Global Privacy Control signal. You may use an authorized agent to submit a request on your behalf, with proof of authorization.
If you are in Canada (PIPEDA), you may request access to the personal information we hold about you, challenge its accuracy and have it corrected, withdraw consent subject to legal and contractual limits, and complain to the Office of the Privacy Commissioner of Canada.
13. How to Exercise Your Rights
Email BeakSchool@beautyofbirds.com with the subject line "Privacy Request" and tell us what you want us to do. You can also change most of your account information, community profile, bird profiles, and email preferences yourself inside your account settings.
We will verify your request by confirming control of the email address on your account, and may ask for additional information if the request concerns sensitive or high-risk data. We aim to respond within 30 days, and within 45 days for California requests, with an extension where the law allows and we tell you why. We do not charge a fee for reasonable requests. If we decline a request, we will explain the reason, for example where we must keep billing records to comply with tax law.
14. International Data Transfers
We are based in the United States and our service providers may process data in the United States and other countries. If you access the Site from outside the United States, your information will be transferred to and processed in the United States, where data protection law may differ from your own. Where we transfer personal information out of the EU, UK, or Switzerland, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum, together with additional measures where needed. You can request more information about these safeguards using the contact details above.
15. Children Under 13
The Site is intended for adults and is not directed to children. We recognize a special obligation to protect information about children age 13 and under. IF YOU ARE 13 YEARS OLD OR YOUNGER, PLEASE DO NOT SUBMIT ANY PERSONAL INFORMATION TO THE SITE OR TO THE COMPANY. If we discover that a child age 13 or younger has created an account or given us personal information, we will delete that information and close the account. A parent or guardian can email BeakSchool@beautyofbirds.com to review, delete, or refuse further collection of their child's information.
We encourage parents to go online with their kids. A few tips to help make a child's online experience safer:
- Teach kids never to give out personal information, including name, address, phone number, or school, unless supervised by a parent or responsible adult.
- Know which sites your kids visit and which ones are appropriate.
- Look for website privacy policies so you know how your child's information is treated.
- Check the FTC's website for more tips on protecting children's privacy online.
16. Links to External Sites
The Site may link to third-party websites, products, and social media pages. We are not responsible for the content or privacy practices of those sites, or for information you choose to share with them. Please review each site's own privacy policy before disclosing information. Neither the Company nor the Site knowingly permits the use of malware, spyware, or viruses.
17. Changes to This Policy and Governing Law
We may update this Privacy Policy from time to time by posting a revised version on this page and updating the "Last Updated" date. Material changes will be communicated by email or an in-app notice where required. Your continued use of the Site after a change takes effect means you accept the updated policy.
This Privacy Policy is governed by the laws of the State of Utah, United States, without regard to its conflict-of-law rules, except where mandatory local privacy law gives you additional rights that cannot be waived. Dispute resolution and venue follow our Terms of Use.
