Beak School Affiliate Program Terms of Service

1. The Program
These terms govern participation in the Beak School Affiliate Program operated by Beak School ("we", "us"). By applying to the program or using an affiliate link, you agree to these terms.
2. Enrollment
You must be 18 or older and provide accurate information. We may approve or decline any application at our discretion. We may require a completed IRS Form W9 (or W8 for non US persons) before any payout is made.
3. Affiliate Links and Attribution
Approved affiliates receive a unique referral link and code. Referrals are attributed by tracking cookie with a 180 day window. A commission is earned when a referred customer completes a qualifying purchase attributed to your link. You may not earn commissions on your own purchases or purchases made through your own link by you, your household, or accounts you control.
4. Commissions
The standard commission is 30% of net revenue on eligible purchases. On a recurring membership, commission is paid on each qualifying payment for up to 12 months from the customer's first payment, after which commission on that customer ends. One on one coaching sessions, trainer bookings, and trainer videos are not eligible and earn no commission, because those sales are shared with the trainer who delivers them. We may update the list of ineligible products, and any change applies only to purchases made after the change is published. Net revenue means the amount actually received by us, excluding taxes, refunds, and chargebacks. We may correct tracking errors in either direction.
5. Refunds, Chargebacks, and Clawbacks
If a referred purchase is refunded or charged back, the related commission is reversed in full, whether or not it has already been paid to you. A partial refund re-computes your commission from the amount the customer actually kept. When the commission was already paid out before the refund happened, the amount is recorded as a clawback and deducted from your future commission, and you can see it in your affiliate dashboard. No commission is payable before the customer's refund window has closed.
6. Payouts
Commission stays pending until your clearance period ends. Your clearance period is shown in your affiliate dashboard and is 30 days unless we have agreed a shorter period with you in writing. Payouts are processed on the first of each month for cleared balances of $50 or more, once your payout details and these terms are on file. Balances under $50 roll forward. Payouts are made by the payment method we support at the time, currently PayPal or another method we agree to in writing. You are responsible for providing accurate payout details and for all taxes on amounts we pay you.
7. Marketing Rules
You must clearly and conspicuously disclose your material connection to Beak School wherever you share your link, in plain language such as "I earn a commission if you join through my link", placed so an ordinary person will see it before or alongside the endorsement, consistent with FTC Endorsement Guides. You must not: send spam; make false, unverifiable, or misleading claims about training results, income, or earnings; bid on Beak School trademarks, brand name, or misspellings in paid search; represent unauthorized discounts or coupons; use cookie stuffing, forced clicks, iframes, or any technique that generates attribution without a genuine referral; offer unapproved cash rebates or incentives for signups; or publish AI generated content presented as personal experience with Beak School that you have not actually had.
8. Instructors, Names, and Likenesses
You may not use the name, image, voice, likeness, testimonial, or identity of any Beak School instructor, expert, contributor, or partner in your advertising or promotional materials without our prior written consent in each instance. Beak School affiliate marketing materials are provided without instructor endorsements, and participation in this program grants no right to imply any instructor's endorsement of you or your content.
9. Limited License
While enrolled, you may use the Beak School name, logo, and marketing assets we provide, solely to promote Beak School under these terms. All goodwill from that use belongs to us. The license ends when your participation ends.
10. Relationship
You are an independent contractor. Nothing here creates an employment, agency, partnership, or joint venture relationship. You have no authority to bind us.
11. Term and Termination
Either party may end participation at any time, with or without cause. On termination, cleared and unpaid commissions earned in good standing before the end date will be paid on the normal schedule. Commissions obtained through fraud, self referral, or violation of these terms are void, and we may withhold or reverse them. We may remove or reassign links of terminated affiliates.
12. Changes
We may update these terms with notice by email or by posting an updated version with a new version date. Continued participation after 30 days of notice constitutes acceptance.
13. Disclaimers and Liability
The program is provided as is. To the maximum extent permitted by law, our total liability to you for any claim related to the program is limited to the commissions payable to you for the 3 months before the claim arose. We are not liable for indirect, incidental, or consequential damages.
14. Governing Law
These terms are governed by the laws of the State of New York, without regard to conflict of laws rules. Any dispute will be resolved in the state or federal courts located in New York County, New York.
